Explanation and implementation of the Legal Maxim regarding “Law of equity” in the light of Islamic and Western Laws: An academic and comperative Review.

Legal Maxims are considerd a distinguishing chapter of the Legal literature. In Islamic Law it is considered an entranceway to ijtih┐d, thus many Jurists enlightend and illuminated the said chapter of legal Science.
Among these Maxims “Law of equity or Ubi Jus Ibi” played a vibrant role in both Islamic as well as Westeran Laws. Experts of both laws inked the explinations and implementations of the aforementioned Maxim in their esteemed works.
“A Selection of Legal Maxims, Classified and illustrated” known as Legal Maxims of Herbert Broom, a Cambridge graduate, has been selected from Western Laws for this study, which focuses on explianation and implementation of the said Maxim in the light of Islamic and Westeren Laws.
